Terms of Service

1. Acceptance of terms

By accessing or using NovaKit ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of service

NovaKit is a Bring Your Own Key (BYOK) AI workspace that provides a user interface for interacting with third-party AI providers. NovaKit does not provide AI models or API access — you must supply your own API keys from supported providers.

3. Your responsibilities

  • You are responsible for obtaining and maintaining valid API keys from AI providers
  • You are responsible for all costs incurred through your API keys
  • You must comply with the terms of service of each AI provider you use through NovaKit
  • You must not use NovaKit to generate content that is illegal, harmful, or violates third-party rights
  • You are responsible for safeguarding your API keys and optional encryption passphrase

4. Licensing and pricing

NovaKit is available in three plans:

  • Free — Limited features, no purchase required
  • Starter — One-time purchase, expanded limits and all providers
  • Pro — One-time purchase, unlimited features and priority support

One-time purchases grant you a perpetual license to use NovaKit, including all future updates and features added to your plan. Prices are listed on our pricing page and may increase over time as we add new features. Your purchase price is locked in at the time of payment and will never increase.

5. Device limits

Each plan allows a specific number of active devices (browsers or installations). If you reach your device limit, you can deactivate a device in Settings to free up a slot. Device IDs are randomly generated and do not contain hardware information.

6. Refund policy

Since NovaKit offers a fully functional free plan, you can evaluate the product before purchasing. Refunds are available within 14 days of purchase if you have not activated your license key. Once activated, refunds are handled on a case-by-case basis. Contact us at support@novakit.ai for refund requests.

7. Data and privacy

NovaKit is a local-first application. Your conversations, API keys, and settings are stored in your browser. We do not have access to your data. For full details, see our Privacy Policy.

8. Third-party services

NovaKit connects to third-party AI providers using your own API keys. We also use a payment partner for license purchases and a hosting provider for the website. Your use of these services is governed by their respective terms. NovaKit is not responsible for the availability, accuracy, or policies of third-party services.

9. Intellectual property

Content you create using NovaKit (conversations, prompts, personas, chains) belongs to you. NovaKit does not claim any ownership over your content. The NovaKit software, brand, and website design are owned by NovaKit and protected by applicable intellectual property laws.

10. Disclaimers

  • NovaKit is provided "as is" without warranty of any kind, express or implied
  • We do not guarantee the accuracy or reliability of AI-generated content
  • We are not responsible for costs incurred through your API keys
  • Cost estimates and calculations are approximate and should not be relied upon for precise budgeting
  • We do not guarantee uninterrupted or error-free operation of the Service

11. Limitation of liability

To the maximum extent permitted by law, NovaKit's total liability for any claims arising from your use of the Service shall not exceed the amount you paid for your license. In no event shall NovaKit be liable for indirect, incidental, special, consequential, or punitive damages.

12. Termination

You may stop using NovaKit at any time. Since data is stored locally, uninstalling or clearing browser data effectively ends your use. We reserve the right to revoke a license key in cases of fraud, abuse, or violation of these terms, with notice where possible.

13. Governing law

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these terms or the Service shall be resolved in the jurisdiction where NovaKit is established.

14. Changes to these terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. Material changes will be communicated via our blog or email for licensed users.
